Purchasing New Image Products

Please read these conditions on purchasing New Image products from Colostrum Australia. Purchasing any New Image product from Colostrum Australia, confirms you are agreeing to only buy for personal use and to not resell within Australia or overseas. To NOT ship to other countries without authority to do so. Shipping to Vietnam for anything other than personal use is completely forbidden by New Image International & Vietnamese Government.

New Image products are restricted to be sold by distributors approved by New Image only, and NOT sold at retail outlets.

Intellectual Property

The Agreement does not transfer from Us to you any of Ours or third party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with Colostrum Australia and its licensors.

Third-Party Services

In using the Services, you may use third-party services, products, software, embeds, or applications developed by a third party (“Third Party Services”).

If you use any Third Party Services, you understand that:

  • Any use of a Third Party Service is at your own risk, and we shall not be responsible or liable to anyone for Third-Party websites or Services.
  • You acknowledge and agree that We shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods or services available on or through any such web sites or services.

Accounts

Where use of any part of our Services requires an account, you agree to provide us with complete and accurate information when you register for an account.

You will be solely responsible and liable for any activity that occurs under your account. You are responsible for keeping your account information up-to-date and for keeping your password secure.

Neither Colostrum Australia, nor its suppliers and licensors, makes any warranty that our Services will be error-free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.

Jurisdiction and Applicable Law

Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of our Services will be governed by the laws of Australia.

The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be the state and federal courts located in Australia.

Changes

Colostrum Australia reserves the right, at our sole discretion, to modify or replace these Terms at any time.

If we make changes that are material, we will let you know by posting on our website, or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new terms will take effect.

If you disagree with our changes, then you should stop using our Services within the designated notice period, or once the changes become effective.

Your continued use of our Services will be subject to the new terms.

However, because of backups and records of deletions, it may be impossible to delete a Visitor's entry without retaining some residual information. An individual who requests to have Personally Identifiable Information deactivated will have this information functionally deleted, and we will not sell, transfer, or use Personally Identifiable Information relating to that individual in any way moving forward.

Return and Refund Policy

The following returns policy applies to all items sold on Colostrum Australia.

If you are not fully satisfied with your unopened purchase, return it. It’s easy! You may return it with your original sales receipt, gift receipt or original packing slip. We will happily exchange the item or refund your full purchase price, less fees if PayPal is used as a payment method.

An item not marked as non-returnable on the product detail page is eligible for return within the applicable return window if it fulfills one or more of the following conditions:

- Was in a physically damaged condition at the time of delivery

- Has one or more parts of accessories missing

- Does not match with what was ordered

Items must be returned in the original manufacturer's packaging. Product purchased must be unopened.

Facebook FB Policy

Colostrum Australia ("we," "us," "our") takes its users ("user", "you," "your") privacy seriously. This Privacy Policy is designed to let you know what information we collect through our Facebook App and/or Fan Page.

We collect information in accordance with this Privacy Policy, and this Privacy Policy only applies to our information collection practices on Facebook. As required by Facebook's Privacy Policy we have to let you know that we do not sell your data, however if we are acquired or are merged we may transfer this data. Application Partners and Third Party Service Providers: We may share your information with third parties we have partnered with specifically for our Application and/or Fan Page. In addition, we may hire outside companies or third parties to help us manage, create, or maintain our Application and/or Fan Page. Other Disclosures and Assurances

We DO NOT sell/transfer/give information about your use of Facebook to third parties unless authorized in this Agreement.

We use reasonable safeguards and protections to protect your data. We may have servers located in different jurisdictions so you are consenting to the transfer of this information from your residence to our servers.

We do not allow users under 13 to use our Application or Fan Page and will delete anyone we suspect is under age.

We may update this Privacy Policy as needed. If we do, we will post a notice on here of the changes and when this Policy was last updated.

However, due to some restrictions across Australia, our warehouse has on occasion had a shortage of stock.  As a result, please expect up to 3 days delay in the processing of orders. Orders can also be collected from our warehouse in Crystal Creek NSW. Collection time is between 9:30am to 4pm Monday to Friday. Orders are usually ready for collection within 3-4 business days. You will receive an email notification once your order is ready for collection. If you do not collect your order within 10 business days, your order will be cancelled and cancellation fees will apply. To arrange a local pick up, please contact us before placing your order.

For Australian orders there is a flat rate of $11.95

Standard Delivery - Express Delivery can incur an extra fee

Please note that if your order is being returned to us because you have provided an incorrect address, the shipping for re-sending the item will not be free. You will be charged the standard shipping rate and an additional return fee.
